This case and the one reviewed in the above opinion were tried together in the court of common pleas and the rulings as to the exclusion of evidence and directing a verdict for the plaintiff, are the same in both cases. They were argued and submitted together in this court, and we find the same errors committed in this that appear of record in the other case.
