Opinion of the Court

This court finds that the questions involved in this case were involved in and disposed of in The County of Miami et al. v. The City of Dayton et al., 92 Ohio St., 215.

It is, therefore, ordered and adjudged that the *691judgment of the court of appeals in this case be, and the same is hereby, affirmed.

Judgment affirmed.
