DAY, J.

Unless new_ facts or conditions, or a subsequent change in the law, have intrvened, whereby the legal relations of parties, fixed by a prior judgment, are changed, such former judgment constitutes a bar to a subsequent action.

Judgment affirmed.

Marshall, CJ., Jones, Matthias, Allen and Kinkade, JJ., concur. Robinson, J., concurs in the syllabus, but not in the judgment.
