Opinion of the Court

*672 It is ordered and adjudged by this court that the judgment of the said Court of Appeals be, and the same hereby is, reversed upon authority of Gee v. State, 60 Ohio St., 485.

It is further ordered and adjudged that said cause be, and the same hereby is, remanded to the court of common pleas, division of domestic relations, of Franklin county, Ohio, for a new trial.

Judgment reversed and cause remanded.
