Opinion of the Court

It is ordered and adjudged that the petition be, and the same hereby is, dismissed for the reason that a peremptory writ of mandamus having been issued in cause No. 24148, State, ex rel. Ellis, City Solicitor, v. Urner, City Aud., ante, 84, further proceedings in this case are not necessary.

It is therefore ordered and adjudged that the writ of prohibition prayed for be, and the same hereby is, denied.

Writ denied.
