Opinion of the Court

By and with the consent of the appellees and at their request, and without consideration by this court of the errors assigned or a declaration of any law, the judgment of the Court of Appeals, affirming the judgment of the Court of Common Pleas, is reversed and the cause is remanded to the Court of Common Pleas for further proceedings according to law.

Judgment reversed and cause remanded by consent.
