This is an original proceeding in babeas corpus wherein tbe petitioner, Louis Beck, seeks to secure bis release from confinement in tbe State Penitentiary.

Tbe petitioner was charged by information filed in tbe district court of Love county with tbe crime of perjury. He together with one E. O. Smith and H. I. Campbell were charged with having committed tbe crime of perjury in tbe trial of tbe case of one Alex Rawls in tbe district court of Love county, upon a charge against tbe said Rawls of attempted rape.

Tbe petition for habeas corpus is in identical language with that considered on this day in the case of Ex parte Smith, 85 Okla. Cr. 299, 187 P. 2d 1003. Tbe facts concerning tbe arrest and plea of guilty by the defendant are substantially tbe same in each of tbe cases of E. O. Smith, H. I. Campbell and Louis Beck, and tbe comment we made in the disposition of tbe case of Ex parte Smith, supra, applies to tbe disposition of this ease.

Tbe writ of habeas corpus is denied.
