Though we by no means insist on a severe application of the rule which requires a subscribing witness to be produced, or his signature to be proved, before proof is made of the party’s handwriting or confessions, yet we are not at liberty to dispense with the rule altogether. We are bound to enforce it wherever the testimony of the witness is within the party’s power,
