Opinion of the Court

The judgment of the Supreme Court was entered,

Per Curiam.

It is unnecessary to decide whether the judgment of the court below, without a service of the writ upon the defendant, was regular, as upon the merits we are of opinion that the relator showed no right under the Constitution and laws to the office held by the defendant, and we affirm this judgment upon the opinion of the learned judge below.

Judgment affirmed.
