People v. Rodríguez

Opinion of the Court

The record and the evidence showing that the defendant did not offer for sale the adulterated milk as pure milk, which was the act charged in the information, but that the adulterated milk found in his possession belonged to another person and the defendant was carrying it to a milk-stall that was not his, considering the cases of People v. Nogueras, 23 P. R. R. 309, and People v. Ojeda, 26 P. R. R. 391, the judgment is reversed and the defendant discharged.
