Opinion of the Court

The opinion of the Court, was delivered by

Johnstone, J.

There seems to be little doubt that the *41certificate of one claiming to be, at the time, Chairman of the Court is, substantially, the certificate of the presiding Judge of the Court.

I am of opinion, therefore, that the authentication is a compliance with the Act of Congress; and that the motion should be refused, and the appeal dismissed, and it is so ordered.
