Opinion of the Court
. This case is reported in Thompson’s Cases, pages 63, 63, as an oral opinion, and it is there stated that the court decided that:
INDICTMENT. For passing- counterfeit money to defraud.
An indictment for passing counterfeit money must charge that it was done with the intention to defraud the person to whom it'was passed, or it will be bad, and the judg-ment will be arrested, because of such omission. [On the subject of counterfeiting, see Code, secs. 6597-6631, and notes.]
