This is an appeal from a summary judgment signed May 19, 2004.  On May 26, 2005, the parties filed a joint motion to dismiss the appeal because the parties have entered into a settlement agreement.  See Tex. R. App. P. 42.1.  The motion is granted.

Accordingly, the appeal is ordered dismissed.
