M E M O R A N D U M   O P I N I O N

This is an appeal from a judgment signed March 15, 2010.  On May 24, 2010, appellant filed an agreed motion to vacate the judgment below and dismiss the appeal because the case has settled.  See Tex. R. App. P. 42.1.  The motion is granted.

Accordingly, we order the judgment below vacated, the cause dismissed, and the appeal dismissed.  See Tex. R. App. P. 43.2.
