THIS CAUSE was submitted to the Court on October 3, 2013, on the record, the Court’s order dated August 26, 2013, and the parties’ failure to respond to the Court’s directive.

The Court, having examined and fully considered the documents on file, is of the opinion that the appeal should be reinstated and dismissed for want of prosecution.

Accordingly, the appeal is hereby REINSTATED and DISMISSED FOR WANT OF PROSECUTION.

Costs of the appeal are adjudged against appellant, JOHN E. FOX. It is further ordered that this decision be certified below for observance.
