TO THE HONORABLE THIRD COURT OF APPEALS: Appellees Joe and Diane Allbaugh [hereinafter “Appellees”] hereby file this unopposed motion requesting this Court grant leave to file a supplemental responsive brief, and in support thereof shows the Court as follows: Timeline of Appeal Appellant’s Brief was filed September 8, 2014. Appellee’s Response Brief was filed October 24, 2014. Appellant’s Reply Brief was filed November 13, 2014. The case was submitted on oral argument on January 28, 2015.

On June 5, 2015, Appellant filed its motion for leave to file a supplemental brief based on a recent decision by the Texas Supreme Court in Gharda USA, Inc. v. Control Solutions, Inc., No. 12-0987 (Tex. May 8, 2015). The motion for leave was granted on June 5, 2015.

Appellees now seek leave to file a supplemental brief addressing the points raised in Appellant’s brief and the Gharda case.
