BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION l. SeCtion 157.162, Family Code, is amended by adding Subsection (d) to read as follows: (d) The court mav not find a respondent in contempt of court for failure to pav child support if the respondent or the resoondent's attornev appears at the hearind with evidence \ satisfactorv to the court showino that: (l) the unpaid child support accrued durino the oblioor's confinement in a local, for a period of at least 90 consecu'ive davS, other confinement: (A) for an offense constituting an act of familv state, or federal iail or prison mm (~me& DAu;v 7__6~.4¢/)€72€7€ Co)\e+`/Neo $,'Nce 02+3.~211 20|1 violence, as defined bv Section 71.004, committed aqainst the oblioee or a child covered bv the child suoport order; or (E) resultind ccmplv with a child Suppcrt order; from the oblioor's failureito and (2) the oblioor did not have sufficient resources available to comolv with the child support order durinc the period> of the obligor's confinement.

SECTION 2. Section 157.162(d), Family Code, as added by this Act, applies to a hearing to enforce an order in a suit affecting the parent-child relationship that commences on or after the effective date of this Act.
