Opinion

TEXAS COURT OF APPEALS, THIRD DISTRICT, AT AUSTIN

JUDGMENT RENDERED FEBRUARY 14, 2023

NO. 03-22-00525-CV

Sammy J. Geiger, Appellant v. Barry Cohen, Appellee

APPEAL FROM THE 146TH DISTRICT COURT OF BELL COUNTY BEFORE CHIEF JUSTICE BYRNE, JUSTICES TRIANA AND THEOFANIS DISMISSED FOR WANT OF PROSECUTION – OPINION BY CHIEF JUSTICE BYRNE

This is an appeal from the judgment signed by the trial court on July 22, 2022. Having reviewed the record, the Court holds that Sammy J. Geiger has not prosecuted his appeal and did not comply with a notice from the Clerk of this Court. Therefore, the Court dismisses the appeal for want of prosecution. Because appellant is indigent and unable to pay costs, no adjudication of costs is made.
