Having considered the motions, the responses, the exhibits, and the case file, the Court finds that Plaintiff’s motion should be DENIED and that Defendant’s motion should be GRANTED IN PART and DENIED IN PART.

It is hereby ORDERED that Plaintiff’s Motion for Summary Judgment is DENIED.

It is further ORDERED that Defendant’s Traditional and No-Evidence Motion for Summary Judgment is GRANTED with respect to Plaintiff’s claims against Defendants.

Accordingly, it is hereby ORDERED that Plaintiff shall take nothing on its claims and Plaintiff’s claims are DISMISSED in their entirety. It is further ORDERED that Defendant’s Motion for Summary Judgment is DENIED with respect to Defendant’s request for sanctions.

It is further ORDERED that each party shall bear their own court costs and attorney’s fees.

It is further ORDERED that all relief requested in this matter that is not addressed herein is DENIED. This is a final, appealable order.
