DICE, Commissioner.

Appellant was convicted of unlawfully selling whiskey in a dry area upon his *583plea of guilty before the court without a jury and assessed punishment at 60 days' in jail and a fine of $200.

The question presented on this appeal is the same as was decided adversely to the appellant in White v. State of Texas, Tex.Cr.App., 321 S.W.2d 582, this day decided.

The judgment is affirmed.
