Blanchard v. At Home Healthcare (Tyler)
Trial Court Opinion
UNITED STATES DISTRICT COURT EASTERN DISTRICT OF TEXAS No. 6:23-cv-00374 Christian Blanchard, Plaintiff, V. At Home Healthcare, Defendant.
ORDER Plaintiff Christian Blanchard filed this action asserting negli- gence claims. Doc. 1. The case was referred to United States Magis- trate Judge K. Nicole Mitchell pursuant to
28 U.S.C. § 636(b). Doc. 2. On October 3, 2023, the magistrate judge issued a report recom- mending that the complaint be dismissed without prejudice for lack of subject-matter jurisdiction. Doc. 8. Plaintiff did not file written objections. When a party fails to object to a magistrate judge’s re- port, the court reviews the record only for clear error. See Douglass vy. United Servs. Auto. Ass’n,
79 F.3d 1415, 1420(5th Cir. 1996). Having reviewed the magistrate judge’s report, and being satis- fied that it contains no clear error, the court accepts its findings and recommendation. The court dismisses this action without prejudice. Any pending motions are denied as moot. So ordered by the court on December 14, 2023.
