Opinion of the Court

OCHILTREE, Justice.

This case has been twice decided by the

tribunals authorized by law to decide cases, where “persons can not agree to a division line of any land which has never been surveyed agreeably to law.” After a deliberate investigation of all the facts contained in the record, we are unanimously of opinion that the judgment of the court below shall be affirmed.

Affirmed.
