MARTIN A. FITZPATRICK,

US Magistrate Judge,

Defendant-Appellee. ____________________

Appeal from the United States District Court for the Northern District of Florida D.C. Docket No. 4:24-cv-00132-TKW-MJF ____________________

Before ROSENBAUM, NEWSOM, and LUCK, Circuit Judges.

PER CURIAM: USCA11 Case: 26-10528 Document: 7-1 Date Filed: 08/18/2026 Page: 2 of 2

2 Opinion of the Court 26-10528 Robert Lee Wright, III, a state prisoner proceeding pro se, delivered a notice of appeal to prison officials for mailing on Feb- ruary 11, 2026. See Fed. R. App. P. 4(c). That notice, which does not designate any order or judgment, is not timely to appeal any order entered in this action. See 28 U.S.C. 2107(b) (providing that, in civil cases in which there is a federal party, a notice of appeal must be filed within 60 days of entry of the appealed judgment or order). The district court’s last order before the notice was filed was entered on October 8, 2025, and judgment was entered on April 30, 2024. Because the notice is untimely, it cannot invoke our appellate jurisdiction. See Green v. Drug Enf’t Admin., 606 F.3d 1296, 1300-01 (11th Cir. 2010) (explaining that, in civil cases, the timely filing of a notice of appeal is a jurisdictional requirement). Accordingly, this appeal is DISMISSED, sua sponte, for lack of jurisdiction. All pending motions are DENIED as moot.
