The Leonard J. Busby

U.S. Court of Appeals for the Second Circuit
The Leonard J. Busby, 241 F. 855 (2d Cir. 1917)
154 C.C.A. 557; 1917 U.S. App. LEXIS 1829

The Leonard J. Busby

Opinion of the Court

COXE, Circuit Judge.

The crucial questions here are questions of fact which were carefully considered by Judge I,earned Hand after *858having seen and heard the witnesses. We see no reason to differ with him, but even if we did do so, we would hesitate to reverse his findings unless fully convinced that he was wrong. In the present case we think the weight of evidence is clearly to the effect that the Busby and not the Reed is responsible for the collision.

The decree is affirmed with costs.
