8 Joseph Rutigliano sued the United States Department of Justice (“DOJ”) seeking an order

9 under the Freedom of Information Act (“FOIA”),

, compelling DOJ to produce a

10 “prosecution declination memorandum” from the United States Attorney’s Office for the Eastern

11 District of New York. After cross-motions for summary judgment, the district court entered

12 judgment in favor of the government and dismissed Rutigliano’s complaint. The district court

13 concluded that the memorandum was exempt from FOIA’s disclosure obligations by 5 U.S.C.

14 § 552(b)(5), which incorporates traditional discovery privileges. Specifically, the district court

15 concluded that the memorandum was exempt under both the attorney work product doctrine and

16 the deliberative process privilege. We assume the parties’ familiarity with the underlying facts,

17 procedural history, and issues on appeal.

18 “We review de novo the District Court’s grant of summary judgment in an FOIA suit.”

, 488 (2d Cir. 2019). FOIA generally allows

20 the public to see documents generated by an agency unless one of the Act’s exemptions applies.

21 NLRB v. Sears, Roebuck & Co.,

421 U.S. 132, 136

(1975). Exemption 5 allows agencies to

22 withhold “inter-agency or intra-agency memorandums or letters that would not be available by law

23 to a party other than an agency in litigation with the agency.”

5 U.S.C. § 552

(b)(5). “Courts

24 universally read this provision to mean that agency documents that would be privileged in ordinary

25 civil discovery are also protected from disclosure under FOIA. Specifically, Exemption 5

2 1 incorporates three judicially-developed (i.e., common law) privileges: the attorney-client

2 privilege, the deliberative process privilege, and the attorney work product privilege.” N.Y. Times,

3 939 F.3d at 488 (citations omitted).

4 Rutigliano appears to argue that Exemption 5 does not cover the prosecution declination

5 memorandum based on his view that the memorandum is exculpatory evidence that the

6 government was required to turn over under Brady v. Maryland,

(1983). But “FOIA

7 is neither a substitute for criminal discovery, nor an appropriate means to vindicate discovery

8 abuses.” Williams & Connolly v. S.E.C.,

(D.C. Cir. 2011) (citations omitted).

9 DOJ met its burden to show that the memorandum falls within the work product and/or deliberative

10 process privileges. DOJ’s declaration, which is “sufficient to sustain the agency’s burden” and

11 “accorded a presumption of good faith,” states facts supporting the applicability of both privilege

12 doctrines. Carney v. U.S. Dep’t of Justice,

(2d Cir. 1994). As stated in the DOJ

13 declaration, the memorandum is attorney work product because it is a communication “between

14 the AUSA . . . and his supervisor” that contains the AUSA’s “personal evaluations and opinions

15 pertinent to the investigation,” “mental impressions,” and the office’s “investigative strategies,”

16 all prepared in anticipation of litigation. Supp. App’x at 20; see N.Y. Times, 939 F.3d at 489.

17 Likewise, it is protected by the deliberative process privilege because it is a pre-decisional, intra-

18 agency document memorializing “deliberations concerning an assessment of the facts that were

19 gathered during the Grand Jury investigation.” Supp. App’x at 20; see Nat’l Council of La Raza

20 v. Dep’t of Justice,

, 356 (2d Cir. 2005). The memorandum is exempt from FOIA

21 disclosure under Exemption 5 because it is protected by the work product doctrine and the

22 deliberative process privilege. Exemption 5 is a “categorical” protection that exempts privileged

23 materials from disclosure even if, in non-FOIA litigation, the underlying privilege could be

3 1 qualified or overcome. FTC v. Grolier Inc.,

(1983) (“Only by construing

2 [Exemption 5] to provide a categorical rule can the Act’s purpose of expediting disclosure by

3 means of workable rules be furthered.”). FOIA does not include a special rule for Brady material.

4 The district court thus properly dismissed Rutigliano’s complaint.

5 Finally, we reject Rutigliano’s contention that the district court abused its discretion by not

6 conducting an in camera review of the memorandum. “When the agency meets its burden by

7 means of affidavits, in camera review is neither necessary nor appropriate.” Larson v. Dep’t of

8 State,

(D.C. Cir. 1979)).

10 We have considered the remainder of Rutigliano’s arguments and find them to be without

11 merit. For the foregoing reasons, we AFFIRM the judgment of the district court.
