ORDER

This cause came on to be heard on the motion of the Drug Enforcement Administration to vacate the September 17, 1996 decision and to dismiss the appeal as moot. On consideration whereof, and in accordance with the panel's written decision it is here ordered and adjudged by this Court that the motion to vacate the September 17, 1996 panel decision as moot and to dismiss the appeal is denied. The Drug Enforcement Agency shall have 14 days from the date of this order
