Herbert Dale Wilkins, Appellant
v.
Raymond K. Procunier, Director of Va. Dept. of Corrections, Appellee.

No. 86-7002.

United States Court of Appeals, Fourth Circuit.

Submitted April 2, 1986.
Decided Oct. 14, 1986.

Before WIDENER and MURNAGHAN, Circuit Judges, and BUTZNER, Senior Circuit Judge.

PER CURIAM.

1

(Herbert Dale Wilkins, Appellant Pro se. Richard B. Smith, Assistant Attorney General, for Appellee.)

PER CURIAM:

2

A review of the record and the district court's opinion discloses that an appeal from its order refusing habeas corpus relief pursuant to 28 U.S.C. Sec. 2254 would be without merit. Because the dispositive issues recently have been decided authoritatively, we deny a certificate of probable cause to appeal, dispense with oral argument, and dismiss the appeal on the reasoning of the district court. Wilkins v. Procunier, C/A No. 83-235-N (E.D. Va., Sept. 4, 1985).

DISMISSED.
