v.
William D. LEEKE, Commissioner, SCDC; and The Attorney
General of The State of South Carolina, Appellees.

No. 85-7092.

United States Court of Appeals, Fourth Circuit.

Submitted June 24, 1986.
Decided Nov. 13, 1986.

Walter Edward Ruff, Jr., appellant pro se.

T. Travis Medlock, Attorney General, for appellees.

D.S.C.

DISMISSED.

Appeal from the United States District Court for the District of South Carolina, at Columbia. Falcon B. Hawkins, District Judge. (C/A No. 3:84-2258-1J)

Before WIDENER and HALL, Circuit Judges, and BUTZNER, Senior Circuit Judge.

PER CURIAM:

1

A review of the record and the district court's opinion accepting the magistrate's recommendation discloses that an appeal from its order refusing habeas corpus relief pursuant to 28 U.S.C. Sec. 2254 would be without merit. Because the dispositive issues recently have been decided authoritatively, we deny a certificate of probable cause to appeal, dispense with oral argument, and dismiss the appeal on the reasoning of the district court. Ruff v. Leeke, C/A No. 3:84-2258-1J (D.S.C., Nov. 29, 1985). Ruff's motion for leave to file a supplemental brief is granted.
