Charles H. WILSON, Plaintiff-Appellant,
v.
SOUTH CAROLINA STATE HIGHWAY DEPARTMENT, Defendant-Appellee.

No. 89-2686.

United States Court of Appeals, Fourth Circuit.

Submitted June 30, 1989.
Decided Aug. 17, 1989.

Charles H. Wilson, appellant pro se.

Before MURNAGHAN, SPROUSE, and CHAPMAN, Circuit Judges.

PER CURIAM:

1

Charles H. Wilson appeals from the district court's order denying relief under 42 U.S.C. Sec. 1983. Our review of the record and the district court's opinion accepting the recommendation of the magistrate discloses that this appeal is without merit. Accordingly, we affirm on the reasoning of the district court. Wilson v. SC State Hwy Dept, C/A No. 89-535 (D.S.C. Apr. 11, 1989). In addition we deny Wilson's petition for writ of mandamus.

2

We dispense with oral argument because the facts and legal contentions are adequately presented in the materials before the Court and argument would not aid the decisional process.

3

AFFIRMED.
