Leonard L. MCGLOTHLIN, Petitioner-Appellant,
v.
W.D. BLANKENSHIP, Respondent-Appellee.

No. 89-7667.

United States Court of Appeals, Fourth Circuit.

Submitted Jan. 31, 1990.
Decided March 12, 1990.

Appeal from the United States District Court for the Western District of Virginia, at Roanoke. James C. Turk, Chief District Judge. (C/A No. 89-60-R).

Leonard L. McGlothlin, appellant pro se.

Robert Harkness Herring, Jr., Office of the Attorney General of Virginia, for appellee.

W.D.Va.

Dismissed.

Before DONALD RUSSELL and K.K. HALL, Circuit Judges, and BUTZNER, Senior Circuit Judge.

PER CURIAM:

1

Leonard L. McGlothlin seeks to appeal the district court's order refusing habeas corpus relief pursuant to 28 U.S.C. Sec. 2254. Our review of the record and the district court's opinion discloses that this appeal is without merit. Accordingly, we deny a certificate of probable cause to appeal and dismiss the appeal on the reasoning of the district court. McGlothlin v. Blankenship, C/A No. 89-60-R (W.D.Va. May 19, 1989). We dispense with oral argument because the facts and legal contentions are adequately presented in the materials before the Court and argument would not aid the decisional process.
