James P. DAVIE, Petitioner-Appellant,
v.
Raymond MUNCY; Attorney General of the Commonwealth of
Virginia, Respondents-Appellees.

No. 90-6366.

United States Court of Appeals, Fourth Circuit.

Submitted Sept. 26, 1990.
Decided March 21, 1991.

Appeal from the United States District Court for the Eastern District of Virginia, at Alexandria. Albert V. Bryan, Jr., Chief District Judge. (CA-89-37-AM)

James P. Davie, appellant pro se.

Robert H. Anderson, III, Office of the Attorney General of Virginia, Richmond, Va., for appellees.

E.D.Va.

DISMISSED.

Before PHILLIPS, WILKINSON and NIEMEYER, Circuit Judges.

PER CURIAM:

1

James P. Davie seeks to appeal the district court's order refusing habeas corpus relief pursuant to 28 U.S.C. Sec. 2254. Our review of the record and the district court's opinion discloses that this appeal is without merit. Accordingly, we deny a certificate of probable cause to appeal and dismiss on the reasoning of the district court. Davie v. Muncy, CA-89-37-AM (E.D.Va. July 2, 1990). We dispense with oral argument because the facts and legal contentions are adequately presented in the materials before the Court and argument would not aid the decisional process.
