UNITED STATES of America, Plaintiff-Appellee,
v.
Allan James BERUBE, Defendant-Appellant.

No. 91-6782.

United States Court of Appeals, Fourth Circuit.

Submitted April 5, 1991.
Decided May 13, 1991.

Appeal from the United States District Court for the Western District of North Carolina, at Shelby. Woodrow Wilson Jones, Senior District Judge. (CR-1272-SH; CA-89-139-SH)

Allan James Berube, appellant pro se.

Thomas J. Ashcraft, United States Attorney, Charlotte, N.C., for appellee.

W.D.N.C.

AFFIRMED.

Before SPROUSE and CHAPMAN, Circuit Judges, and BUTZNER, Senior Circuit Judge.

PER CURIAM:

1

Allan James Berube appeals from the district court's order refusing relief under 28 U.S.C. Sec. 2255. Our review of the record and the district court's opinion discloses that this appeal is without merit. Accordingly, we affirm on the reasoning of the district court. United States v. Berube, CR-1272-SH; CA-89-139-SH (W.D.N.C. Jan. 24, 1991). We dispense with oral argument because the facts and legal contentions are adequately presented in the materials before the Court and argument would not aid the decisional process.
