UNITED STATES of America, Plaintiff Appellee,
v.
Yul CARTER, Defendant Appellant.

No. 93-6964.

United States Court of Appeals, Fourth Circuit.

Submitted: March 17, 1994.
Decided: March 29, 1994.

Appeal from the United States District Court for the Southern District of West Virginia, at Charleston. John T. Copenhaver, Jr., District Judge. (CR-90-41-2).

Yul Carter, appellant pro se.

Michael Lee Keller, Office of the United States Attorney, Charleston, West Virginia, for appellee.

S.D.W.Va.

AFFIRMED.

Before PHILLIPS and LUTTIG, Circuit Judges, and BUTZNER, Senior Circuit Judge.

PER CURIAM:

1

Appellant appeals from the district court's order denying his motion for a new trial pursuant to Fed.R.Crim.P. 33. Our review of the record and the district court's opinion discloses that this appeal is without merit. Accordingly, we affirm on the reasoning of the district court. United States v. Carter, No. CR-90-41-2 (S.D.W. Va. Aug. 17, 1993). We dispense with oral argument because the facts and legal contentions are adequately presented in the materials before the Court and argument would not aid the decisional process.
