Barry UTSEY, Plaintiff--Appellant,
v.
George ROOF, Superintendent, Campbell Work Release Center,
Defendant--Appellee.

No. 94-7352.

United States Court of Appeals, Fourth Circuit.

Submitted Jan. 19, 1995.
Decided Feb. 21, 1995.

Barry Utsey, Appellant Pro Se. John Gregg McMaster, Jr., TOMPKINS & MCMASTER, Columbia, South Carolina, for Appellee.

Before WILKINS and MICHAEL, Circuit Judges, and SPROUSE, Senior Circuit Judge.

PER CURIAM:

1

Appellant appeals from the district court's order denying relief on his 42 U.S.C. Sec. 1983 (1988) complaint. Our review of the record and the district court's opinion accepting the recommendation of the magistrate judge discloses that this appeal is without merit. Accordingly, we affirm on the reasoning of the district court.* Utsey v. Roof No. CA-93-2600-3-2BC (D.S.C. Oct. 3, 1994). We dispense with oral argument because the facts and legal contentions are adequately presented in the materials before the Court and argument would not aid the decisional process.

AFFIRMED

*

In light of this disposition, Utsey's motion for appointment of counsel is hereby denied
