Appellant appeals the district court's orders denying relief

on his

42 U.S.C. § 1983

(1994) complaint and denying his motion for

reconsideration. We have reviewed the record and the district

court's opinions and find no reversible error. Accordingly, we af-

firm on the reasoning of the district court. Smith v. Jarvis, No. CA-97-570-5-H-3 (E.D.N.C. Aug. 26, 1997; Sept. 24, 1997). We dis-

pense with oral argument because the facts and legal contentions

are adequately presented in the materials before the court and argument would not aid the decisional process.
