Submitted: February 12, 1998 Decided: February 26, 1998

Before MURNAGHAN and WILLIAMS, Circuit Judges, and PHILLIPS, Senior Circuit Judge.

Affirmed by unpublished per curiam opinion.

Charles R. LaBoone, Appellant Pro Se. Collin Jefferson Hite, SANDS, ANDERSON, MARKS & MILLER, Richmond, Virginia, for Appellees.

Unpublished opinions are not binding precedent in this circuit. See Local Rule 36(c).

2 PER CURIAM:

Appellant appeals from the district court's order denying

relief on his

42 U.S.C. § 1983

(1994) complaint. We have reviewed

the record and the district court's opinion and orders and find no

reversible error. Accordingly, we affirm on the reasoning of the

district court. LaBoone v. Murray, No. CA-97-288-R (W.D. Va. Aug. 27, 1997). Appellant's motion for appointment of counsel is denied.

We dispense with oral argument because the facts and legal conten-

tions are adequately presented in the materials before the court and argument would not aid the decisional process.
