UNPUBLISHED

UNITED STATES COURT OF APPEALS FOR THE FOURTH CIRCUIT

No. 99-7018

UNITED STATES OF AMERICA,

Plaintiff - Appellee,

versus

ELAN CHRISTOPHER LEWIS, a/k/a Jamal Xavier Harris,

Defendant - Appellant.

Appeal from the United States District Court for the Eastern Dis- trict of Virginia, at Richmond. Richard L. Williams, Senior Dis- trict Judge. (CR-94-94, CA-98-12-3)

Submitted: October 7, 1999 Decided: October 14, 1999

Before MURNAGHAN, LUTTIG, and MOTZ, Circuit Judges.

Dismissed by unpublished per curiam opinion.

Elan Christopher Lewis, Appellant Pro Se. David T. Maguire, Assis- tant United States Attorney, Richmond, Virginia, for Appellee.

Unpublished opinions are not binding precedent in this circuit. See Local Rule 36(c). PER CURIAM:

Elan Christopher Lewis seeks to appeal the district court’s

order denying his motion filed under

28 U.S.C.A. § 2255

(West Supp.

1999). We have reviewed the record and the district court’s opin-

ion and find no reversible error. Accordingly, we deny a certifi-

cate of appealability and dismiss the appeal on the reasoning of

the district court. See United States v. Lewis, Nos. CR-94-94; CA-

98-12-3 (E.D. Va. July 2, 1999). We dispense with oral argument

because the facts and legal contentions are adequately presented in

the materials before the court and argument would not aid the

decisional process.
