PER CURIAM: Roy F. Hillberry, II, appeals the district court’s order dismissing his 28 U.S.C. § 2254 petition as untimely. The district court granted a certificate of appealability. We have reviewed the record and find no reversible error. Accordingly, we affirm the district court’s order. Hillberry v. Straughn, No. 5:23-cv-00125-JPB-JPM (N.D. W.Va. Sept. 7, 2023). We dispense with oral argument because the facts and legal contentions are adequately presented in the materials before this court and argument would not aid the decisional process.
