United States v. Toscano-Garcia
United States v. Toscano-Garcia
Opinion of the Court
MEMORANDUM
Jose Toscano-Garcia appeals from his guilty plea judgment and conviction for reentry after deportation, in violation of 8 U.S.C. § 1326(a). Toscano-Garcia’s counsel has filed a motion pursuant to Anders v. California, 386 U.S. 738, 87 S.Ct. 1396, 18 L.Ed.2d 493 (1967), stating that there are not arguable issues for review and seeking to withdraw as counsel of record. Toscano-Garcia has not filed a pro se supplemental brief.
As part of the plea agreement, Tosaea-no-Garcia waived the right to appeal his sentence and conviction. Having independently reviewed the record, we are satisfied that the plea agreement, including the waiver of the right to appeal, was entered knowingly and voluntarily. United States v. Aguilar-Muniz, 156 F.3d 974, 976 (9th Cir. 1998). We therefore enforce the waiver, grant the motion to withdraw, and dismiss the appeal.
DISMISSED.
