Opinion of the Court
MEMORANDUM
Petitioner Rade Pavlovic, his wife Vera, and their two children
The BIA denied Pavlovic’s application for asylum as untimely under 8 U.S.C. § 1158(a)(2)(B) and found that he did not qualify for an exception under 8 U.S.C. § 1158(a)(2)(D). We have no jurisdiction to review the BIA’s determination.
We grant Pavlovic’s claim for review of his withholding of removal application.
The IJ found that Pavlovic suffered past persecution due to his political opinions. Thus, he is entitled to a presumption of a well-founded fear of future persecution.
Pavlovic did not present evidence sufficient to meet the “more likely than not” burden of proof required to obtain protection under the Convention Against Torture.
PETITION DISMISSED IN PART, DENIED IN PART, AND GRANTED AND REMANDED IN PART.
This disposition is not appropriate for publication and may not be cited to or by the courts of this circuit except as provided by Ninth Circuit Rule 36-3.
. The claims of Pavlovic’s wife and children are dependent on his claim. See 8 C.F.R. § 208.21. Therefore, all references to the petition will hereinafter be to Pavlovic’s petition.
