MEMORANDUM
On December 3, 2004, we filed a memorandum disposition affirming Joaquin Chavez-Cruz’s sentence. On February 28, 2005, the Supreme Court granted Chavez-Cruz’s petition for a writ of certiorari, vacated our judgment, and remanded for further consideration in light of United States v. Booker, — U.S. -, 125 S.Ct. 738, 160 L.Ed.2d 621 (2005). The record does not show how the district court would have proceeded had it known that the Sentencing Guidelines were advisory rather than mandatory.
