Opinion
NOT FOR PUBLICATION FILED UNITED STATES COURT OF APPEALS AUG 31 2026 MOLLY C. DWYER, CLERK U.S. COURT OF APPEALS FOR THE NINTH CIRCUIT AMIERR AYAID ABDUL AZIZZ, AKA No. 24-6642 Ronald W. Bratton, D.C. No. 5:20-cv-03885-BLF Plaintiff - Appellant, v. MEMORANDUM* C. YOUNG, ADA Coordinator; et al., Defendants, and A. MAXFIELD, Correctional Counselor II, Appeals Coordinator; et al., Defendants - Appellees.
Appeal from the United States District Court for the Northern District of California Beth Labson Freeman, District Judge, Presiding Submitted August 25, 2026** Before: SILVERMAN, N.R. SMITH, and DE ALBA, Circuit Judges.
* This disposition is not appropriate for publication and is not precedent except as provided by Ninth Circuit Rule 36-3.
California state prisoner Amierr Ayaid Abdul Azizz appeals pro se from the district court’s post-judgment order denying his motion to refund the filing fee in his 42 U.S.C. § 1983 action. We have jurisdiction under 28 U.S.C. § 1291. We review for an abuse of discretion. Taylor v. Delatoore, 281 F.3d 844, 847 (9th Cir. 2002). We affirm.
The district court did not abuse its discretion in denying Azizz’s motion to refund the filing fee because the Prison Litigation Reform Act (“PLRA”) does not provide any authority or mechanism for the district court to return the filing fee after dismissal of an action. See 28 U.S.C. § 1915(a), (b)(1); Taylor, 281 F.3d at 847 (“Under the PLRA, all prisoners who file [in forma pauperis] civil actions must pay the full amount of the filing fee.”).
To the extent Azizz seeks to challenge the district court’s underlying judgment, we do not consider his contentions because they are outside the scope of this appeal.
The motion (Docket Entry No. 14) to refund the appellate filing fee is denied.
AFFIRMED.
