Antoine Bordelais v. United States
Opinion
United States Court of Appeals
FOR THE DISTRICT OF COLUMBIA CIRCUIT ____________
No. 24-5169 September Term, 2026 1:24-cv-00770-UNA Filed On: September 18, 2026 Antoine Bordelais,
Appellant v.
United States of America,
Appellee
ON APPEAL FROM THE UNITED STATES DISTRICT COURT
FOR THE DISTRICT OF COLUMBIA
BEFORE: Wilkins, Walker, and Garcia, Circuit Judges JUDGMENT
This appeal was considered on the record from the United States District Court for the District of Columbia and on the brief filed by appellant. See Fed. R. App. P. 34(a)(2); D.C. Cir. Rule 34(j). Upon consideration of the foregoing and the motion for leave to file a corrected cover page, it is
ORDERED that the motion for leave to file a corrected cover page be granted. It is
FURTHER ORDERED AND ADJUDGED that the district court’s order filed May 6, 2024, be affirmed. The district court correctly dismissed appellant’s claims under the Federal Tort Claims Act (“FTCA”) based on that statute’s foreign-country exception. See 28 U.S.C. § 2680(k). “[R]egardless of where” any “tortious act or omission occurred,” that “exception bars all” of appellant’s FTCA claims because any injury that he suffered occurred “in a foreign country.” Sosa v. Alvarez-Machain, 542 U.S. 692, 712 (2004), overruled in part on other grounds by Cisco Sys., Inc. v. Doe I, 146 S. Ct. 1882 (2026).
Pursuant to D.C. Circuit Rule 36, this disposition will not be published. The Clerk United States Court of Appeals
