Opinion of the Court

NEWMAN, Circuit Judge.

ORDER

The Department of the Navy moves without opposition to remand this case to the Merit Systems Protection Board for further consideration.

The Navy asserts “that the MSPB may have failed to distinguish between two different personnel actions” and, thus, Kenneth L. Woodworth may be entitled to further consideration of some of his allegations before the MSPB.

Upon consideration thereof,

IT IS ORDERED THAT:

The motion to remand is granted.
