Opinion

Case: 26-149 Document: 9 Page: 1 Filed: 09/17/2026

NOTE: This order is nonprecedential.

United States Court of Appeals for the Federal Circuit ______________________ In Re RAJ K. PATEL, Petitioner ______________________ 2026-149 ______________________ On Petition for Writ of Mandamus to the United States Court of International Trade. ______________________ ON PETITION AND MOTION ______________________ PER CURIAM.

ORDER Before the court is a petition for a writ of mandamus filed by Raj K. Patel. According to the petition, Mr. Patel has twice attempted to file a complaint at the United States Court of International Trade, and on both occasions, the Court of International Trade returned the complaint un- docketed. He now seeks a writ of mandamus directing the Court of International Trade to docket his complaint. He also moves for leave to proceed in forma pauperis.

Issuance of a writ “is a drastic and extraordinary rem- edy reserved for really extraordinary causes.” Cheney v. U.S. Dist. Ct. for D.C., 542 U.S. 367, 380 (2004) (cleaned up). A petitioner seeking such relief must show: (1) “no Case: 26-149 Document: 9 Page: 2 Filed: 09/17/2026

2 IN RE PATEL other adequate means to attain the relief he desires,” (2) a “clear and indisputable” right to relief, and (3) the writ is “appropriate under the circumstances.” Id. at 380–81 (ci- tation omitted). Mr. Patel fails to meet that standard at least because he makes no non-frivolous argument for why the Court of International Trade would have jurisdiction to consider his complaint.

Accordingly, IT IS ORDERED THAT: The petition and all pending motions are denied.
