PeR Curiam:

The facts in this case are not materially

different from those in Great Lakes Dredge & Dock Company v. The United States, No. 45623, decided January 7, 1946 (104 C. Cls. 818), and the contentions of the two parties in the two cases are substantially the same. For the reasons stated in the Great Lakes Dredge & Dock Company case plaintiff’s petition in this case will be dismissed. It is so ordered.
