On a memorandum report .of the commissioner stating that at a pretrial conference the parties had reached agreement based on the court’s decision in The Western Pacific Railroad Company v. United States, 137 C. Cls. 394, it was ordered that judgment for the plaintiff be entered for $13,500.95, and that defendant’s counterclaim be dismissed.
