On May 15,1964, the court rendered an opinion, 166 Ct. Cl. 39,340 F. 2d 645, holding that plaintiff was entitled to recover in an amount to be determined in further proceedings under Eule 47(c) (2). On September 28,1965, the court issued an order adopting the recommendation of the trial commissioner based on a stipulation of settlement of the parties filed September 16, 1965, and entered judgment for plaintiff in the amount of $30,000.
