The Court (Morsell, J., absent,)

at the request of Mr. Wal-lach and Mr. Dandridge, for the defendant, instructed the jury that a promissory oath could not be the subject of a prosecution for perjury.

Memorandum. January 14th,. 1832. On account of the session of the Supreme Court of the United States, this Court adjourned to the third Monday in March next.
