Opinion by

In accordance with stipulation of counsel that the merchandise consists of ceramic rods, not decorated, the same in all material respects as those the subject of John H. Faunce, Philadelphia, Inc. v. United States (42 Cust. Ct. 196, C.D. 2085), the claim of the plaintiff was sustained. Protest 58/23250 having been abandoned as to entry No. 12762, was dismissed to that extent.
